Prof. Guangjian Tu, Professor of the Faculty of Law at the University of Macau (UM) and a member of the Financial Innovation Team at the Asia-Pacific Academy of Economics and Management (APAEM), has recently had his article cited by the United States Federal Court of Appeals for the Second Circuit in a judgment for the case of Smart Study Co. v. Shenzhenshixindajixieyouxiangongsi. The article, titled “Service of Process (Documents) in International Civil and Commercial Proceedings: A Critical Review of the Chinese Approach,” was published in (2014) 13 Chinese Journal of International Law, pp. 577-604 (Q1, SSCI).
In the article, Prof. Tu systematically examined the Chinese approaches against the backdrop of globalization, clearly explained how the Hague Service Convention should operate in cases involving China, and demonstrated the Chinese attitudes and laws for the issues. The Second Circuit Court of Appeals occupies a prominent position in the US, whose cases have been closely followed or observed by many other courts in the US. By this judgment which has also benefited from Prof. Tu’s writing, Chinese litigants can be better protected in the area of international civil and commercial litigation.
